If the lawyers lead, the judges will follow

Judge Posner, influential federal appellate judge (Seventh Circuit*) and self-described legal pragmatist, is guest blogging over at Larry Lessig’s website. (Via Professor Bainbridge.) Agree or disagree, Posner is an incisive writer and a true judicial luminary — as Article III Groupie might have put it (but, sadly, didn’t), he’s a “male Superhottie of the Federal Judiciary“!

I’m as surprised as y’all that I actually wrote that. Typically, it takes a couple beers . . . . . 😉

*The Seventh Circuit handles most civil and criminal appeals from federal trial courts in Wisconsin, Illinois, and Indiana.

**For the record, Judge Kozinski of the Ninth Circuit was crowned the #1 male superhottie of the federal judiciary. As one commentator noted:

“Look, on the men’s side, there’s no contest here. After all, the contest is for the ‘hottest’ judge, right? Alex Kozinski (aka AK-47, AK, Hotpants, the Romanian Love Machine) wins hottest, hands-down. You can keep your clean-cut Jeff Suttons. He might be the kind of judge you want to bring home to mom, but ‘hot’ he ain’t.”

The “Hot. Kimba M. Wood” (Southern District of New York — a trial judge) won for the women:

This voter for Judge Wood summed it up quite nicely: “If Kimba Wood is not the winner, there is surely no justice in law. While all of the nominees are, I’ll concede, hot, she has so much foxiness it hurts.” Or consider this less eloquent but more pithy commentary: “Kimba Wood. Kimba Wood. Kimba Wood. Wow. She is hot.”

And indeed she is.

    Too liberal on cultural issues for cultural conservatives (Republican); too conservative on economic and other issues for liberals. And he’s not a strict constructionist — his “pragmatism” is the conservative equivalent of legal realism.
    Similar explanation for why (libertarian-leaning) Judge Kozinski of the 9th Circuit won’t make Scotus. (Kozinski is perhaps my favorite jurist).
