‘Cuz I think Harley gets twitchy without a Plame thread…

Testimony from Karl Rove, which included a flat denial that he was the anonymous leaker in the Plame case… has been anonymously leaked to The American Prospect. Somebody in TalkLeft’s comment section claims that this is perfectly legal, as the attorneys were only requested to keep things quiet, but… I’m sorry, folks, I tried, but this entire thing went past farce and hit parody smack dab in the center ring. This last bit merely confirmed it for me.

Don’t let me stop you from talking about it, though. Maybe I’m in denial, or something.

  1. Well, not twitchy exactly, but.
    I’d suggest ignoring the farcical aspects, as I’m sure Fitzgerald is, and focusing on the possible lawbreaking involved.

  2. IANAL, but this by an assistant professor of law jibes with my understanding:

    Current grand jury secrecy rules apply only to jurors, prosecutors and courtroom staff. Patriot II would expand them to apply to witnesses too – meaning that ordinary citizens could not discuss their testimony with anyone but their attorney.

    It therefore depends who leaked the testimony to the grand jury, though the odds would seem to suggest the likelihood — but not surety — of it being illegal. Any lawyer with better knowledge is welcome to correct me.

  3. What’s the beef, Moe? Should we drop the whole thing because an unspecified agent behaved badly? Two people out a CIA agent but we are to drop it because somebody leaked Rove’s testimony. Could it have been Rove that leaked it? It’s in his interest to have it out there that he had nothing to do with it.
    The Plame game is not a farce, its a tragety.

  4. If our friends over at DU are to be believed, Rove would have leaked the exact opposite, allowed the meme-machine to run with it until Kerry finally picked it up, and then put the kibosh on it. Because that’s how devious and sinister a guy he is.

  5. Starr’s office leaked all over Washington during Clinton’s presidency. Does that have anything to do with Plame’s identity and job being revealed to a reporter (I’m being generous with that reporter label)?
    No.
    According to Moe’s logic though perhaps they are.
